Negligent conduct with respect to pulling down or repairing buildings

Section 288 of the Indian Penal Code, 1860 (Negligent conduct with respect to pulling down or repairing buildings) corresponds to Section 290 of the Bharatiya Nyaya Sanhita, 2023, in force from 1 July 2024. Under the BNSS First Schedule, BNS 290 is non-cognizable, bailable, triable by Any Magistrate; punishment: Imprisonment for 6 months, or fine of 5,000 rupees, or both.

Text of BNS Section 290

290. Whoever, in pulling down, repairing or constructing any building, knowingly or negligently omits to take such measures with that building as is sufficient to guard against any probable danger to human life from the fall of that building, or of any part thereof, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to five thousand rupees, or with both.

Conveying person by water for hire in unsafe or overloaded vessel.

Danger or obstruction in public way or line of navigation.

Negligent conduct with respect to poisonous substance.

Negligent conduct with respect to fire or combustible matter.
