Punishment for bribery
Section 171E of the Indian Penal Code, 1860 (Punishment for bribery) corresponds to Section 173 of the Bharatiya Nyaya Sanhita, 2023, in force from 1 July 2024. Under the BNSS First Schedule, BNS 173 is non-cognizable, bailable, triable by Magistrate of the first class; punishment: Imprisonment for 1 year or fine, or both, or if treating only, fine only.

The BNS applies to offences committed on or after 1 July 2024. Offences committed earlier are charged and tried under the IPC.
173. Whoever commits the offence of bribery shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both:
Provided that bribery by treating shall be punished with fine only.
Explanation.—‘Treating” means that form of bribery where the gratification consists in food, drink, entertainment, or provision.
