83. Whoever, dishonestly or with a fraudulent intention, goes through the ceremony of being married, knowing that he is not thereby lawfully married, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Section 496 of the Indian Penal Code, 1860 (Marriage ceremony fraudulently gone through without lawful marriage) corresponds to Section 83 of the Bharatiya Nyaya Sanhita, 2023, in force from 1 July 2024. Under the BNSS First Schedule, BNS 83 is non-cognizable, non-bailable, triable by Magistrate of the first class; punishment: Imprisonment up to 7 years and fine.
