(2) Whoever, except in the case provided for by sub-section (1) of section 122 voluntarily causes hurt, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to ten thousand rupees, or with both.

Section 323 of the Indian Penal Code, 1860 (Punishment for voluntarily causing hurt) corresponds to Section 115(2) of the Bharatiya Nyaya Sanhita, 2023, in force from 1 July 2024. Under the BNSS First Schedule, BNS 115(2) is non-cognizable, bailable, triable by Any Magistrate; punishment: Imprisonment for 1 year or fine of 10,000 rupees, or both.
